Indonesian Bankruptcy Law was initially enacted through Government Regulation in Lieu of Act No. 1 of 1998 which was then approved by the Indonesian Parliament as law and became Law No. 4 of 1998 which then further amended by Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Repayment Obligation (“Bankruptcy and PKPU Law”). Since then, there was no amendment to the Bankruptcy and PKPU Law.

We have heard many stories telling that employees being terminated by having a marital bond or blood relationship with other employee in the same company. Under the Article 153 (1) (f) of Law No. 13 Year 2003 regarding Manpower (“Manpower Law”), the employers has the rights to terminate their employee under those circumstances, as long such rights have been stated in the employment contract; company regulation; or collective labor agreement. Employers consideration will mostly due to the condition that such marital bond or blood relationship will give effects to their work performance; including the possibility to conduct certain action beneficial for each other position under those marital bond or blood relationship.

  INTERLOCKING DIRECTORSHIP apparently is one of few issues in Law Number 5 Year 1999 regarding Prohibition of Monopolistic Practices and Unfair Competition (“Competition Law”) that has been frequently asked during legal consulations, apart from other issues such as cartel, intellectual property and distribution/exclusive agreements.

Berakhirnya tahun 2017 menandai episode yang cukup menantang bagi Komisi Pengawas Persaingan Usaha (KPPU) dalam menjalankan tugasnya sebagai otoritas persaingan sesuai dengan Undang-undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat (UU No. 5/1999).

KPPU melanjutkan komitmennya untuk tetap intensif melakukan pengawasan di bidang-bidang industri yang memiliki dimensi publik secara luas, seperti komoditi pangan, telekomunikasi, energi dan consumer goods, melalui dua hal yang menjadi tugas utamanya: pencegahan dan penegakan hukum.

KPPU juga berusaha mensinergikan tugasnya di bidang persaingan usaha dengan ikut serta melakukan koordinasi dengan Pemerintah maupun Kepolisian dalam upaya untuk meredam gejolak harga beberapa komoditi pangan seperti garam, cabe, beras, jagung, dan daging sapi.
